The type of personal information we collect

We currently collect and process the following information:

  • Identity data, such as title, name and user ID.
  • Contact data, such as your address, billing address, email address and telephone numbers.
  • Financial data, such as bank and payment card details.
  • Transactional data, such as payments made by and to you, and details of services provided to you.
  • Technical data, including your IP address, login information, browser type and version, time zone setting and location, browser plug-ins and other technology on the devices used to access our website.
  • Profile data, including your purchases or orders, your interests and preferences, and any feedback or survey responses you provide to us.
  • Usage data, including how you use our website, products and services.
  • Marketing and communications data, including your preferences in relation to marketing from us and from any third parties, and your preferences for methods of communication.
  • Special categories of personal data: owing to the products and services that we offer, The Ethical Property Company PLC sometimes needs to process sensitive personal information (known as ‘special category data’) to ensure your health and safety, e.g. information on allergens. Where we collect such information, we will only request and process the minimum data necessary for the specified purpose and will identify a compliant legal basis for doing so. 
  • CCTV images are used for the prevention, detection and investigation of criminal activity and to keep our guests and staff safe. It is our policy not to disclose images to anyone other than the police.

Personal data of third parties

If you act on behalf of or book a viewing for another person, we will also collect their data for the purposes outlined in this Notice.

Failure to provide personal data

In some cases we may need to collect your personal data by law, or in order to perform our side of a contract we have entered into with you, or with a view to entering into such a contract. If you fail to provide the requested data, we may not be able to perform under the contract we have with you, or to enter into the contract with you. In such circumstances we may have to cancel the contract, or be unable to fulfil the contract, which means we would not be able to provide the product or service to you. If that is the case, we will notify you of this at the time.

Collection of personal information via cookies

Personal data is collected regarding a user’s journey through our website, and the placement of cookies throughout our site allows us to enhance the user journey. This data is held for use in Google Analytics to enable us to better understand customer behaviour and to better deliver our products or services.

The information generated by these cookies (including your truncated IP address) is transmitted to and stored by Google on servers in the US. Google uses this information for the purpose of evaluating your and others’ use of our website, compiling reports for us on website activity, and providing other services relating to website activity and Internet usage.

Please note that Google only receives your truncated IP address. This is sufficient for Google to identify the country from which you are visiting our site, but is not sufficient to identify you, or your computer or mobile device, individually.

Third party advertising

We use these cookies to help ensure that our share advertisements and other communications are relevant to users and to measure how our visitors are interacting with our marketing and advertising materials. These cookies may be set by The Ethical Property Company PLC or by our advertising partners. They may be used to build a profile to show you relevant advertisements on other sites. Automated technologies or interactions – when you interact with our website, we may collect some technical data relating to you, including details about your devices or browsing patterns. This data may be collected using cookies (see above) or other similar technologies.

When you opt out of receiving marketing messages, this will not apply to personal data provided to us because of a product/service purchase, warranty registration, product/service experience or other transactions.

Disclosure of your information to third parties

The personal data you provide to us may be accessed by or given to third parties, some of whom may be located inside or outside the UK and European Economic Area (‘EEA’), who act for us for the purposes set out in this Notice or for other purposes approved by you. Those parties process information, fulfil and deliver orders, process credit card payments and provide support services on our behalf. 

We may also pass aggregated information on the usage of our website to third parties, but this will not include information that can be used to identify you, either directly or indirectly.

Where you have specifically consented when providing us with your details, we may also allow carefully selected third parties to contact you occasionally about products and services which may be of interest to you. They may contact you by email. You can withdraw your consent to this at any time. If you change your mind about being contacted by these companies in the future, please let us know at marketing@ethicalproperty.co.uk

If our business enters into a joint venture with or is merged with or sold to another business entity, your information may be disclosed to our new business partners or owners. Countries outside the UK and EEA do not always have strong data protection laws.

We will take steps to ensure that your data is used by third parties in accordance with this Notice. Unless required or permitted by law to do so, we will not otherwise share, sell or distribute any of the information you provide to us without your consent.

International data transfer

Some of the third parties that we may disclose your personal data to are based outside the UK and EEA, so their processing of your personal data will involve a transfer of your personal data outside the UK and EEA. Whenever we transfer your personal data outside the UK and EEA, we will ensure that it is afforded a similar degree of protection by ensuring at least one of the following safeguards is implemented:

  • We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the UK.
  • Where we use certain service providers, we may use specific contracts or UK model clauses.
  • Where we use providers based in the US, we may transfer data to them if they are part of the Privacy Shield, which requires them to provide similar protection to personal data shared between the UK and the US.

Information retention

We will retain your personal data for as long as we need it for the purposes for which we collected it, or if we are legally required to do so.

The Ethical Property Company PLC only retains personal data for as long as is necessary, and we have strict review and retention policies in place to meet these obligations. Generally, where we have a contractual relationship with you, we will retain your data for a period of seven (7) years from the date our contractual relationship ends unless we are legally required to retain it for a longer period.

Where you have consented to us using your details for direct marketing, we will keep such data for 36 months from the date of your latest consent or until you notify us otherwise and withdraw your consent.

Data security

The Ethical Property Company PLC takes all appropriate technical and organisational measures, in accordance with local law requirements, to protect your personally identifiable information against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access. To this end, we have implemented technical measures such as firewalls and operational measures such as login requirements, efficient passwords and physical protection.

Your rights as a data subject

As an individual, as a data subject under Data Protection Law in relation to the processing of your personal data, you have the right to:

  • Be informed about how The Ethical Property Company PLC collects and processes your personal data, as explained in this Privacy Notice.
  • Request access to your personal data (a ‘data subject access request’), which enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it.
  • Request amendments to the personal data that we hold about you, to have any incomplete or inaccurate information corrected.
  • Request erasure of your personal data, such that we delete or remove personal data where there is no good and lawful reason for us to continue to process it (although in some cases we can refuse this request, where we can claim exemptions as a data controller).
  • Object to the processing of your personal data where we are processing this data for direct marketing or where we are relying on a legitimate interest (of The Ethical Property Company PLC or of a third party) and there is something specific to your situation which gives rise to your objection.
  • Request the restriction of processing of your personal data through the suspension of our processing, e.g. where you want us to establish its accuracy or the reasons for processing.
  • Request the transfer of your personal data to another party.
  • Withdraw consent at any time where we are relying on consent to process your personal data (although this will not affect the lawfulness of any processing carried out before the withdrawal of consent).
  • Where processing is required under a contract or by consent, request that a decision made using automated processing of your personal data, which significantly affects you, be reviewed by an individual to whom you may make representations and contest the decision.

We do not usually charge individuals for any requests made regarding the collection of information. However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances. We will need you to identify yourself formally prior to responding to your request. As such, we may request a valid form of identification such as a current driver’s licence, identity card or passport.

Changes to our Privacy Notice

The Privacy Notice was last updated on 01/02/2022. To assist us in keeping the personal data we process about you accurate and up to date for the duration of your relationship with us, it is important that you inform us of any change to your personal data that you have provided to us as soon as possible, by contacting us at data.protection@ethicalproperty.co.uk. We keep our Privacy Notice under regular review, and we will place any updates on our website.

Concerns or complaints

The Ethical Property Company PLC processes your personal information in compliance with this Privacy Notice and in accordance with the relevant data protection law. If you wish to raise a complaint regarding the processing of your personal data or are unsatisfied with how we have handled your information, you have the right to lodge a complaint with the supervisory authority, the UK Information Commissioner’s Office (ICO).
